Labour Court to take over striking doctors’ matter if parties fail to agree

NAIROBI, Kenya, 13 March 2017  – The Court of Appeal will revert the arbitration of doctors’ strike to the Employment and Labour Relations Court if the mediators do not come to an agreement by 10:00 a.m on Tuesday.

The three-judge bench headed by Lady Justice Martha Koome urged the mediators to work together to sign and register a return-to-work formula by Tuesday although the Council of Governors had requested for more time to analyze the return-to-work formula before it is signed and registered in court.  The Ministry of Health however, maintained that no more talks will be held until the striking doctors resume work.

On Thursday 9th March, 2017, the government suspended further negotiations with the Kenya Medical Practitioners and Dentists Union unless they resume work. The doctors who have been working during the strike were promised a pay rise backdated to January 1, 2017.
